Privacy Complaints Target TikTok and Chinese Firms

In a wave of privacy complaints, the Austrian group NOYB, led by activist Max Schrems, has launched a challenge against major Chinese tech firms like TikTok, Shein, and AliExpress. The core issue revolves around the alleged illegal transfer of user data from the EU to China, which is considered a breach of the General Data Protection Regulation (GDPR). This regulation mandates that data transfers can only occur if adequate protection measures are in place, a point NOYB argues is not being met by these companies.

According to GDPR lawyer Kleanthi Sardeli, the current data practices fail to protect EU users from potential access by Chinese authorities, raising significant privacy concerns. NOYB's complaints not only target Chinese corporations but also include US giants such as Apple and Meta. The group's aim is to halt these data transfers and implement severe penalties, potentially reaching up to 4% of the companies' global annual revenue.

Previously, NOYB's actions have led to significant fines, evidenced by their successful case against OpenAI in April 2024. The organization contends that transparency reports reveal unauthorized governmental access to personal data in China, which contravenes GDPR standards. Despite requesting detailed disclosures from the accused companies, NOYB received insufficient responses, prompting the legal action.
