BSW's Struggle with Electoral Threshold and Recount Requests
The recently concluded federal election in Germany has seen the Bündnis Sahra Wagenknecht (BSW) narrowly miss entering the Bundestag, falling short of the crucial five percent threshold. Despite garnering an additional 4,072 second votes, the party's overall share was 4.981 percent, just shy of the mark needed to secure representation in the parliament.
BSW's attempts to challenge this outcome have so far been unsuccessful. Their requests for a recount were rejected by both the Federal Constitutional Court and the Wiesbaden Administrative Court. The Federal Constitutional Court stated that intervention is limited unless errors significantly affect the seating distribution in the Bundestag. BSW's appeal was also turned down by the Hessian Administrative Court.
While the official results were largely consistent with the preliminary outcomes, minor corrections were reported in regions like Niedersachsen, Bayern, and Baden-Württemberg. These did not, however, alter the final seat allocation. Notably, issues such as incorrect ballot distributions and instances of double voting were identified, but these were not substantial enough to change the election results.
The CDU/CSU emerged as the strongest party with 28.5 percent, followed by the AfD, SPD, and Greens. The FDP also fell short of the five percent hurdle, similar to BSW. As the BSW considers further legal steps, the party's leader, Sahra Wagenknecht, is contemplating filing an election review complaint, as permitted by Article 41 of the Basic Law, which could lead to a protracted legal process.
Despite these setbacks, the election saw a remarkable voter turnout of 82.5 percent, the highest in nearly four decades, highlighting the electorate's engagement in shaping the nation's political landscape.
